Names on the deed

We have a family trust(husband and wife) Our house is NOT in the trust. In a short time our daughter and family will be moving in. Who's name should be on the deed(house is paid for) My husbands mother is also residing at this house. She is NOT on the deed.

Should we proceed and put the house in the trust where our daughter is the beneficiary of the trust.

Without knowing your intentions for what is to be done with the house after you and your spouse die, it is difficult to know how to advise you.

However, if you have already created a trust as part of your estate plan to hold the home, I would put the house in the name of the trust.

If you have an attorney who prepared your estate plan I would consult him or her. If you are unclear as to what to do, I would consult an attorney.

As Attorney Roth said, without viewing your estate plan as a whole, it is hard to advise you as to this one transaction.

I would place a quick call to the attorney who helped you prepare your estate plan. If that is not helpful, I would also be happy to review your estate plan, and help you carry it out.
