Legal Question in Real Estate Law in Massachusetts
neighbor problems
I live on a small narrow street where no parking is allowed. There are fire lane no parking signs posted on both sides, but the neigbhors who rent the house next to mine are always parking on the sidewalk outside my driveway making it hard for me to get in or out of my property/driveway. When I ask them to move the cars they call me names and make me feel threatened. These people are renters and the landlord doesn't seem to care. The renters are constantly changing. They're Usually young people who come and go every six months to a year. Can I sue landlord because I am not able enjoy the use my proprerty and sometimes feel unsafe do to his tenants. He knows he does not have enough parking for the amount of people he rents to. That landlord lives in different community, one of the richest in the state and occaissionally comes by to collect rents. This has been going on for years. Problems with the people he rents too that is. The houses in question has 3 legal parking spaces, but there are 4 apartments with multiple cars per apartment. I'm constantly having to call police etc. and I'm tired of having to do that and tired of being called a bitch because I want to be able to access my driveway. My mother owns house I live in.

Re: neighbor problems
I think you have a valid issue with your neighbors. You may have a claim for trespass. However, you want to put pressure on the landlord. You may want to make a complaint to the town building inspector to see if there are too many tenants in the home than what the zoning regulations permit.
Re: neighbor problems
You certainly have reason to complain. First, I would contact the Building Dept or talk to the Police as well. This might put pressure on the landlord. You may have a claim for trespass and nuisance.
Good Luck.
