Legal Question in Real Estate Law in Massachusetts

Neighbors leaves and brush spill over onto my property.

My neighbors lawn is on a slightly higher grade than mine with the slope being on his side. For years he has been putting leaves and grass clippings within the line of overgrown bushes on this slope. Lately they are starting to slide over to my side and I thought I might talk to him about it but just this past week he dumped a pile of leaves and grass around the bushes about 6 feet onto my property. Am I being challenged to defend my property?

Could it be that this was just a mistake? It is always better to discuss the matter rationally with neighbors and to avoid unnecessary escalation.

However, if there is a bona fide dispute about a property line, it would probably be wise to resolve it before there is more significant action involved (e.g. removal/planting of trees, building of a structure, etcetera).

I don't think you are being challeged to defend your property and I would suggest you talk to your neighbor politely and in a freindly manner. If he asserts the area is his, then you may need to take some additional action.
