Legal Question in Real Estate Law in Massachusetts

neighbor's video camera

Can a neighbor place a video camera pointing into another neighbor's backyard? My daughter has 3 small boys and is nervous about this man taping them when they're in the backyar.

Re: neighbor's video camera

If he is taping her backyard, it is an invasion of her privacy. She should request he remove it in writing. If he refuses, she should go to town officials or the town police department and seek their assistance. Baring that she can file a lawsuit seeking removal of the camera or at a minimum that it be directed in such a fashion not to cover her property.

If this is a security measure for the neighbor's home the cameras can be set in such a manner as to provide security without video taping her backyard.
