noisy neighbors
What can a renter of a condo do about neighbors who have children running and jumping at all hours of the day and night? I can't watch t.v., listen to the radio, read, and "god forbid" SLEEP! in my own home. Condo association states "not their problem". I have pictures falling off the walls and dishes "rattling" in the cabinet. HELP!

1. If you have not already done so, try very nicely to explain the problem to the offending neighbor. Maybe the spirit of the holiday season will work to your benefit.
2. Review both your rental agreement (if any) and the condominium documents.
3. Ask your landlord for help (although the often referred to "covenant of quiet enjoyment" probably does not apply in this case, it is possible that your landlord may still be forced to assist under another theory.
4. Try talking to the condo manager and/or association, again.
5. Call the Police and see if they will help under the theory that your neighbor is disturbing the peace. (This is a serious step and may engender a reprisal from the neighbor!)
6. Hire a real estate attorney with specific experience in landlord-tenant matters.

The landlord has a covenant of quiet enjoyment with the tenant. Although the landlord is not creating
the noise, he is responsible to rent a premises that you can enjoy. If the noise level is unreasonable,
then your remedy is against your landlord.
