Legal Question in Real Estate Law in Massachusetts

Non payment of settlement

We purchased a home from a lawyer and his wife in Feb 2003. The Title V certificate was fraudulant and the septic system failed. We were awarded a settlement on Feb. 9, 2007 (one day before going to trial). The defendant had 30 days to pay the settlement. He now refuses to pay and I'm not sure that our attorney is fighting to get the funds. According to Superior Court, our case has been dismissed. Our attorney is not returning our phone calls. This case is 4 years old and has cost us thousands of dollars to get to this point. We don't know where else to turn. Last we heard from our attorney the defendant wanted a tax credit once we installed the new system even though he hasn't owned the property for 4 years. HELP!!!!!!!!

Some layers are more well versed in executing judgments than others. The aggressive and thorough executioner always gets more, sooner. There are many, many ways and means to execute judgments, some that are seldom used but are very effective ways to turn paper judgments into money. Contact me if you need this kind of help getting paid.

Re: Non payment of settlement

Did you get a judgment or a settlement? If it was a settlement, did you and the defendant sign an agreement or did the court enter an order with regard to the settlement.

If you want a second opinion on the matter, please feel free to contact me without obligation.
