Legal Question in Real Estate Law in Massachusetts
Is it possible ot vote someone out of a condo?
I live in a four unit condo building that was converted from a multi-family house two years ago. All owners bought at the same time and each unit has a trustee. One unit owner has tried to take control and basically, to make a long story short, has made the rest of our lives miserable. He is now trying to buy another unit in the building so that he has a 50% vote (he has $$$). Also, his wife does the finances and she has not kept us informed about where our money has gone. When another unit owner approached her, she was very defensive and said that if anyone else takes over, they will screw everything up. A majority of trustees have voted to change the building to pet friendly and this other unit owner has tried to do everything to stop us. Three of us get along great and really enjoy living around each other. The other owner doesn't even live in the building, but rents to his son. We are all sick of living like this and are thinking about selling, but that hardly seems fair. Is there anything that we can do to get rid of these people?

Read your condo agreement and ByLaws and if not understood take them to an attorney. You likely have an absolute right to request in writing to review the financial reports and receive periodic accountings and to call meetings to vote issues by majority. Happy Thanksgiving!

There are a number of options depending upon the terms of your condo documents. Regardless, there needs to be an annual accounting of the condo association fees and expenses.
I suggest you contact a real estate attorney in your area and take him a copy of the Condo documents and start from that point.
