Legal Question in Real Estate Law in Massachusetts
Overcharge
If Trustees of a Condo Association find that they have overcharged/undercharged Unit Owners, are they obliged to inform them? I ask this because the by-laws refer to the owners as the ''beneficiaries'' of the Trust.

Re: Overcharge
I believe the trustees of the condominium trust owe the duty of disclosure to the unit owners. People who buy condominium units buy into a democracy. There should not be an adverse relationship between the unit owners and the organization of that runs the trust for the benefit of the unit owners.
