ownership of land

i bought property with my neighbor, we each own it in whole together, her boyfriend, whom isn't on the deed keeps digging up the property and tells me I'm not allowed on it. He tried came at me with the tractor the other day when i told him to stop digging. i called the police and they say they can't make him stop and she can speak for both of us on the digging, and i can't get a restraining order on him even though i'm in fear for my kids. what recourse do i have?

Retain an attorney to file a Petition to Partition the Tenancy in Common.

That is simply not true.

You can go to the clerk's office and file an application for a criminal complaint for an assault.

You may also go to Superior Court and seek a civil restraining order.
