partition

I own a duplex with my sister. She doesnt want to pay any expenses and also doesnt want to sell or buy. I want to partition the property. Everyone says it is expensive. What is the ''average'' cost for a partition.

It is hard to give an "average" price to you because it somewhat depends on how litigous your sister gets and how much delay tactics she employs her lawyer to perform. If she wants to be difficult and doesn't mind spending her own money to delay you, it could cost up to $5,000 or so. If not, probably around $3,000 - $4000 I would estimate. Again, this is a guess and it could be more. You have to realize going into it, that it may get costly, but it will likely prevail in the end and be worth whatever you pay to achieve it. You can ask the court to award attorney's fees to you for your costs if she uses frivolous tactics to delay an unavoidable outcome. You may or may not get this award. There are filing costs. The variable is if you want to do it your self, or hire an attorney. The other is under what circumstances the court orders a sale. These are unknowns.
