Legal Question in Real Estate Law in Massachusetts

Partition

My sibling and I own a house �tenants in common�. I have filed for partition, it has been 1.5 years and he has trashed the home, my lawyer has gone through the home. He has just spent the last 30 days in jail for not paying child support. I have paid all the insurance and taxes and he will not reimburse me, let alone the home going down the drain. His present home is in foreclosure. He�s looking for a free ride. I believe my present attorney has dropped the ball. I live out of state and my attorney was to go to court with the judge. I find out that there was a continuance and the judge was not there. I /we need to get beyond this, he is trying to drag everyone he knows down in the gutter with him. I would like to get this home on the market and move on.

Funny people tell me he is well known for his antics around the court house and police department and everything should be in favor of getting this done. But??

I would talk to your attorney, about your concerns. However if you are unhappy with your legal counsel after speaking with him, then I would suggest hiring another attorney.

A Petition to Partition case can take time, but you should be able to get to trial soon. If your sibling is in jail, that may have caused the continuance.
