He's not paying his rent.
we serve an eviction notice, he didn't move, we went to court just last week and he won't pay his rent. He moved in Dec.2000, he signed a ''statement of condition'' saying everything was up to snuff. How can we collect on back rent?

I assume you went to court last week for a Summary Process Hearing? If so, the judge will determine who gets possession of the unit and how much rent is owed. Assuming the judge finds in your favor for possession and for back rent and the tenant does not voluntarily pay, you would then need file a Supplental Process suit in District Court. The judge would examine the tenant to see if he/she has the ability to pay back the judgement. This will cost you additional money and you may never see a dime from the tenant.
