A petition to partition is a legal action filed in the Probate Court asking the Court to divide real property owned by two or more people between the owners. The Court can order that the property be physically divided, if that is feasible, or that it be sold and the proceeds be divided. It cannot be used to divide property owned by a husband and wife as tenants by the entirety.
