Petition to Partition

I had a petition to partition claim filed against me. It was entered in oct. 2003 and I had until Dec. 2003 to contest, which I did not. Nothing has been done since that time and I was wondering if there would be some sort of expiration date to it and maybe it is no longer valid. Could you please advise me?

It is most likely a default was entered against you and a default judgment as well. You should call the court and find out the status. If the default judgment was entered you will need to hire an attorney to get it set aside if possible.

If you do nothing, the court will proceed to Order the partition and that will be done pursuant to a court order.

Again first thing is to contact the Court and findout the status of the matter.

Check with the Court. You may have been defaulted for not answering the complaint you say was served upon you and now must attempt to have the default remove or a default judgment may issue against you if it has not already done so.
