can a petition to partition be used in tenants by entirety

Tenancy by the entirety requires the owners of the property be married to one another. If you are married to one another, I do not believe the remedy of a partition is available to you, and you must resolve the issue of your real estate as part of your divorce proceedings. If you are already divorced, then your tenancy by the entirety is converted to a tenancy in common. You should speak to an attorney.
