Legal Question in Real Estate Law in Massachusetts

Pets & Condo Associations

We own a unit in an apartment building that was converted to condos. During the 4 years that we have lived here there have been pets in the building. (dogs & cats) We recently purchased a very small dog and have been informed by Property Management that we must get rid of the dog within 12 days. Do we have any recourse??

Re: Pets & Condo Associations

Hi-

The by-laws, master deed and rules and regulations of the condominium association should contain provisions regarding pets.

These documents are generally given to you (and or your attorney) at the time the purchase contracts are signed for your review and approval.

If you do not have a copy of these "condo docs" ask the management for a copy of them.

You may be able to petition to the Board of Trustees that hired the property management, to ask for permission to have the pet, if the documents do not allow it. However, the Board of Trustees has wide powers to regulate matters such as pets and condo fees.
