Legal Question in Real Estate Law in Massachusetts
I plan on buying a 2 family home and living in 1 of the apartments and renting the other to a family member, my question is what is the legal way to have tenants, who are already living there, move? Id like to move in right after closing but I dont know how long I might have to wait for the tenants to move.

If the tenants have a lease you need to wait until the lease ends. Ih there is no lease, they have to be served with a 30 day notice to quit. If there is no lease you may be able to negotiate for the current owner to make them move. Another way to get the tenant out is to pay the tenant money to move early. I recomend that you hire an attorney to assist you as there is the potential for problems in this purchase.
I agree with Attorney Pransky that you should hire an attorney to properly evict the tenants to avoid their possibly counter suing you potentially for triple damages and their attorney's fees should you make a mistake and violate their rights under the consumer protection law.
