Legal Question in Real Estate Law in Massachusetts

property line driveway

Recently purchased home. the nieghbor has no driveway. we asked if it was shared or any easments and in the ps trealtor said there were none. Now the nieghbor claims otherwise. Her chidren park in middle of drive way blocking it and say just beeb and they will move.How should this be handled?

If you purhased title insurance review the title policy. If not, you could call the closing attorney and ask for a copy of the title search and that should indicate any easements or agreements.

If you were represented by your own attorney at closing, ask him for the information.

There should have been a title search that would have disclosed this impediment. Whether such a license or easement or some legally enforceable right of way exists is something that needs to be researched.

A mere assertion that something is does not alone make it so.
