Legal Question in Real Estate Law in Massachusetts

I am a property owner and I have a tenant that moved in and never signed a lease. She has not paid rent in a couple of months and I need to get her out or I wont be able to pay my mortgage. How can I force her to leave?

First, never allow a tenant to take possession without signing a lease in advance.

Answer, send her a 14 day notice to quit . Either send her a notice certified return receipt or have a constable serve it for you. You need to prove she was served. Once she fails to pay the back rent within the time period, then you file a Summary Process Eviction. The process can take 30-60 days or more to complete the eviction depending on what stalling tactics she uses.
