Legal Question in Real Estate Law in Massachusetts
Property rights
I am in a property dispute with my neighbor. It seems between our properties there was to be a street, dating back to the 1950's, yet it was cancelled. For several years we assumed a part of land was ours since it naturally looked like part of our property. It turns out that the neighbor actually owns a curved section of the land, much like how a curb on the corner of a street would look. Isn't there a law that makes the property ours, since we assumed it was ours for several years?
Thank you

Re: Property rights
You are on the right track but you should get a more precise understanding from a qualified attorney. Seek the advice of an attorney qualified in the area of real estate before you discuss this with the neighbor or other neighbors or even friends of yours. The law is definitely NOT intuitive (it's not what you'd think!) and many a case based on this law are quickly lost because someone says what they think they should be saying to support their case and they hurt their case.
In fact, this particular area of law that you're referring to is understood well by only a few attorneys so get one qualified in that area. I can help you in Eastern Massachusetts in general and there's a woman I feel is an expert that can handle such cases in the Southeastern and middle of the state. If you are, say, west of Worcester County, I might also be able to find you a qualified attorney.
Call me at (617)527-0050 if you like, but DO please heed my advice and find an attorney first before you talk about this with anyone else (especially the neighbor).
