Legal Question in Real Estate Law in Massachusetts

When I purchased my home, and again when I refinanced my home I had to pay for title insurance. When I sold my home the title was not clear, and I had to pay to have it fixed. So� why did I pay for an insurance that did not insure me?

Did you submit a claim on your title insurance?

If they weren't alerted to the claim, how could they address it?

I presume you have health insurance...The doctors still send YOU the bill, right?

If you had owner's title insurance, then you should submit a claim. If you only had title insurance for the Mortgage company, then you did not have coverage. This is why I recommend my clients get Owners' title insurance.

Whenever a lender makes a first mortgage loan, they require Mortgagees Title Insurance.
