Legal Question in Real Estate Law in Massachusetts

My question is, my husband obtained a mortgage in 1999 for approx. 150,000.00. We were current up until 2007, he obtained this mortgage with no income verification, and unfortunately he has undergone 5 surgeries since then, we originally had a different mortgage company and it was sold to Washington Mutual, we did one refinance, not sure of the date though. Now that he is unemployed because he is disabled, we are almost 3 years behind on taxes and mortgage payments, we filed for a re modification but have not got an answer yet. I am afraid we are going to be foreclosed on, and we have a disable son who has Cerebral Palsy and cannot get housing, is there any law that should of known that with a no income verification that if something had arose (like a permanent injury to the borrower? I have a very low paying job and am not on the mortgage (lawyer suggested I should not be), my husband also suffers from post traumatic stress, due to an armed robbery in 2008, what should we do? We paid faithfully for almost ten years and put down approximately $50,000.00 on this home. Thanks, any advice would help.
