real estate petition
how long does a petition to partition take to settle in court,and what are reasons to oppose this action,ive been told once the petition is filed it would be at least a year before court orders home listed for sale,also if someone is appointed to sell home what is their customary percentage

It takes as long as it will take for a "master" appointed by the court to market the property.
Possible "defenses" would be to demonstrate the property could be equitably divided physically or by putting it in trust or otherwise dividing it equitably by agreement. Good Luck!
