Legal Question in Real Estate Law in Massachusetts

Real estate sales commission question

This is a question pertaining to Real estate sales commissions in Masachusetts. I am a licensed Real Estate Salesperson but I have never worked in the real estate field . I am currently in the process of looking for a home to purchase. I am trying to find out if I am entitled legally to collect a portion of the sales commission when I purchase my home even though I have never worked for a broker. I am not working through a broker to find my home, I am basically conducting the search on my own.

I might know this one from personal experience!

I am in the same position -- or was two years ago when I was shopping for this house.

Are you a lawyer? Lawyers can get that license merely by asking for it, which I did when I got my license to practice law; that is, there's no need to take an additional test after the bar exam.

I'd rather talk to you on the phone about my answer. Will you please call me?

Broker represents seller

You are not legally entitled to collect a portion of the sales commission. The broker isan agent of the seller. You, as the buyer, cannot be the agent of the seller.Nevertheless, it is a common practice for a buyer with a broker's license to receive aportion of the commission. You can certainly ask the listing broker. You should beaware that you could have problems in the event you wish to sue the seller since byaccepting the commission, you are now the agent of the seller.
