Legal Question in Real Estate Law in Massachusetts

rental deposit

My roomates and I recently found an apartment to move into and the realitor asked a one month deposit to take it off the market. We have signed only the rental agreement stating that we knew there would be a fee, we have not signed a lease. The problem is now we don't want to move in there, am I going to get my deposit back??

The terms of the rental agreement will determine whether you are entitled to the return of your deposit. If unsure, retain an attorney to review it with you. Good Luck!

One would have to see the document that yu signed. It may or may not bind you to the unit. It is hard to tell if the one month funds you gave to hold the apartment could be viewed as a holding fee or an escrow amount. You need to speak to the realtor, or contact an attorney.
