Legal Question in Real Estate Law in Massachusetts

Return of Last Months Rent

I moved out of my apartment 3 months before the lease was up because my landlord failed to make repairs to my apartment. The repairs were to be made within 30 days of my move in date, according to the lease. Now he says that he will not return my last months rent because I broke the lease. I paid my rent for the month of May, and moved out before the end of the month. The last months rent would have been for June if I had been there. He re-rented the apartment the first week of June. Am I entitled to get my last months rent back?

Re: Return of Last Months Rent

It sounds like you should get your money back. I suggest that you sue in small claims court.

I agree with Alan Pransky. Sue in small claims court. From what you said, you ought to win.
