Legal Question in Real Estate Law in Massachusetts

sale of a Condo owned equally by two people

If a sale takes place and the agent is a friend of one of the owners and makes the check out to only one of the co-owners is this legal, if I do not know about it as a co-owner

More facts about this tranaction would be useful. The legal documentation from the sales transaction must be examined. Generally, when real property is "co-owned" (there are numerous co-ownership arrangements), proceeds from the sale are dipersed to each party (you did not say how the title was held, what disbursement instructions were given [if any], whether there were any "withholds or "offsets", etc.).

You should seek legal counsel asap. You will want to have all of the documentation available prior to consultation.
