Legal Question in Real Estate Law in Massachusetts

security deposit

As a tenant, I terminated the lease in a furnished apartment last month. It was a 10-month lease. The landlord returned my security deposit but with deductions.

1. Cleaning charges: the apartment was left as clean as I got. There was no statement of condition provided by the landlord at time of lease.

2. Interest: no interest on security deposit was provided to me.

3. The apartment was part of an apartment complex. The complex management in conjunction with the owners got the apartment windows of all apartments changed. In my apartment the landlord had put some extra frames on the windows. When the window guys came and changed the windows, they threw those frames. The landlord is blaming me for my irresponsibility. Now I was not present while the windows were being changed, as I believe it is not my responsibility. My only responsibility was to let the window people inside the apartment. The landlord was overseas at that time. So the landlord deducted the cost of the extra window frames from my security deposit.

I feel I am not responsible for all of the above, and I should receive all of my security deposit. Please advise.

Re: security deposit

I suggest that you sue the landlord in small claims court. Don't forget to ask for treble damages.
