Selling House
My mother left the house to my brother and I and I moved in to take care of him, which he wanted, with my husband and step-son, as he may need a heart transplant. He is thinking of moving in with my cousin, who came out of know where and took right over, and wants to sell the house. I have been paying for everything since my mother died 1-19-05. His son, 21 yrs. old, moved in downstairs and doesn't give me a dime to pay anything except his DSL! He will be going to Colorado in June and thats probably when everything will take place. Do I have to sell my half of the house? What are my legal rights, I must have something to hold on to the family home, please help me, Thank you!!

Your Brother can file a Petition to Partition to sell the property. You should contact an attorney to review the title and protect your interest.

Retain an attorney to protect your interest since your brother could petition the Court to partition the property if it was left to you and him as tenants in common, but not if it was left to the two of you as joint tenants or in trust. Good Luck!
