Legal Question in Real Estate Law in Massachusetts

I signed a lease on July 1 to live in an apartment as of July 1. I continued to reside at my other place becaue I had to pay july 1 rent. 2 weeks ago i was told by the new landlord that I couldnt reside in the new place yet because they didnt get the occupancy permit....mind you we had been told we could live there the day we signed the lease. We have to be out of our current apartment on August 1 and they dont have any answers yet. What can we require them to do for us?

A landlord is bound by certain covenants within the Commonwealth of Massachusetts, one of the foremost being to deliver the leashold interest at the time of occupation. A breach of that covenant would presumably allow the tenant to sue the landlord for damages.;)

This is information that the landlord should have known and communicated to you.

I cnnot think of any reason to the contrary.
