I signed a lease with rental agent and paid a fee to the agent, but the apartment was not ready and she will not return her fee. Who is responsible?

You do not indicate whether you terminated the lease or the landlord terminated the lease or made other arrangements for you.

The fee you paid was to get an apartment and if the apartment was not ready and you were forced to make other accommodations, then you are entitled to a refund from the agent, The agent did not get you the apartment.

Look at your agreement with the realtor carefully or make an appointment with an attorney. Was the fee earned when you signed a lease, or when you moved in, or some other milestone? You may also take a look at your lease to see what remedies exist in the event that the apartment is not available or suitable to move in.
