Singed Contract, They deposited check and now wont give us the place
Hello my name is--name removed--. Over three months ago in April my girlfriend, three other friends and myself decided to rent a house (Duplex) from First Choice Realty on Mass Ave. We looked at the place, signed the lease and gave them a check for the first months rent of $3,050(Deposited on 4/18). Now three months later, we are trying to get in touch with our agent Vince and today we find out that the landlord want to keep the previous tenants and we have been trying for the longest time to get the contact information of our future landlord. Now its July we have to move out of our apt by the end of August and we are now in trouble since it will be hard for us to find living for 5 people this late in the year. My question is, since I have taken business law, is that once we sign the lease and they deposit the check aren't the legally binded to honor the contract. We are really mad and are thinking about contacting a lawyer. If I can get any reponse on this that would be great.

Generally speaking, yes, once the lease has been signed and your rent has been accepted by the landlord - a valid lease exists.
