my sister had a action for partition put on a house. My brother is buying her out. Who is responsible to pay to have the action for partition taken off of the house

It should be part of the settlement agreement, but if not, then I would think the moving party would be required to provide the discharge or removal of the lien as it is a cost of discharging her lien from the property.
