Legal Question in Real Estate Law in Massachusetts
Our tenant is in arrears on an agreement to pay his security deposit at a rate of 200.00 per month for ten months. Also his rent is 1,000.00 and he just today gave me a check for 800.00 for February rent. What should I do? Deposit check and tell him he has seven days to pay the remaining 200.00 or return check to him and tell him he has seven days to pay me the full rent of 1000.00? Just as background the electric company just informed him yesterday that they are going to turn off his service for nonpayment.

My advice (I am a landlord and an attorney) would be to begin eviction proceedings immediately. If he ends up paying you in the end - great! If not, you are going to sit with an empty apartment. The sooner you can get started the better.
Obviously he is having financial problems.
Talk to him and try and work something out that works for both of you.
