The language of your written lease will generally be controlling in this case. If this is a violation of your lease, then your tenant has violated the lease.

HOWEVER, be very careful that your lease does not violate the law. You should note that unless the lease specifies otherwise, the law does not entitle you to a key to the premises, and you may not enter the premises without the permission of the tenant (except for emergency situations).

Even then, you are only permitted to enter the premises:

1. To inspect the premises;

2. To make repairs;

3. To show the premises to prospective tenants, purchasers, etc;

4. Pursuant to some court order, etc.
