Legal Question in Real Estate Law in Massachusetts

Terminating contractor with realtor

My friend wants to terminate his contractor with his realtor. He signed for 6 months (his mistake) and she has done very little to market the property. He is very unhappy with her services. He told her he wants to terminate their contract, she then informed him that even if he terminated the contract, he would still owe her the 5% commission if he sold the property on his own. I believe this is 1000% incorrect and that she is lying to him. I can understand it if it was a person she had already brought in to see the house, but not someone who had nothing to do with the realtor. How can my friend find out exactly what the law states about terminating a contract with a realtor???

Re: Terminating contractor with realtor

I'm both a broker and an attorney. If you are unhappy with your broker, you should be able to terminate the contract. The contract likely has a provision in it saying that broker gets a commission if you sell it within ___ months of the termination of the contract. I would have to look at your contract to tell you exactly what your risks are. Feel free to call my office to discuss this at no charge.
