Legal Question in Real Estate Law in Massachusetts

The town won't accept my nuiscance letter re: Empty lot tree damage!

Hello,

I got some great advice on this site a few weeks ago when I posted a question titled ''Empty lot tree damage''. Well, I took your advice and I wrote a letter to the town to file a nuiscance order. Well, when I called the town hall (Wakefield, MA) to see who the letter should be addressed to, they told me that the town would not accept such a letter! The building inspector said that the nuiscance has to affect the entire town!!! Now I am back to square one! Any suggestions on how I can get this property cleaned up??? Any help would be greatly appreciated!!!

Thank You!

Below is my response to your previous inquiry, suggesting you determine who owns the property and complain to them (I would also copy the Town on the letter, but copy the mayor/executive and the public works department, not the building inspector). I would be happy to help you prepare and serve such a letter, and do so affordably.

"The area sounds like it could be unsafe to kids, a so-called "attractive nuisance." If so, you could send a demand letter demanding the area be cleaned up to avoid injuries to kids. Failure to do so would expose owner to possible liability if kids get hurt there after ignoring a request to prevent that from happening. Contact if you need help."
