Transfering real estate to a spouse

I've been divorced from my ex

husband for over thirteen years and I

need to have him to deed our house

to me.. He told me that he doesn't

have any money and I will have to

pay the lawyer. Also. how much will

it cost me? Do i just take the real

estate taxes billing to the lawyer or

do I have to go to the Town office to

get a description on the property.

A deed is simple. and you can get a copy of the prior deed from the registry of deeds on line.

It will cost you about $125.00 filing fee and the preparation of a deed should cost no more than $150.00. The issue is the basis upon which he is giving you title, as part of the divorce or in lieu of money he owes you. If it is in lieu of alimony that raises other issues including whether there are deed stamps to pay. $4.56 per $1000.

You need a legal description for the attorney. If you do not have it, depending on the county you reside you can print a copy of the deed on line.

Most attorneys should be able to prepare a deed for you for a simple flat fee. You would then need to have your husband properly sign the deed and record it in the appropriate registry of deeds.
