Legal Question in Real Estate Law in Massachusetts

Tree Branches

I have some branches that have to be trimmed as they hang over my house. The trees are on my neighbors property. I called someone to do this, and he said that the branches should be trimmed as close to the thee as possible to avoid dammage to the tree. He will climb the tree and trim them. This means going onto my neighbors property to do this.

I thought that I could cut branches to the property line without being sued. Who is right.

Try to ask your neighbor for permission to go onto the property to trim the branches.

Re: Tree Branches

You should ask your neighbors permission to go onto his property to trim the branches.

If he does not premit you to do this, then send him a certified letter informing him that if anything happens to your home as a result of the branches you will hold him responsible. Do this politely.

You can also ask the town to come out and look and see if they will order the neighbor to remove or trim the branches.

Good luck.
