Legal Question in Real Estate Law in Massachusetts
A tree grows through a fence
A young maple grows through a chain link fence which separates our homes. Where the tree grows is approximately 10 ft. away from my house, if that. I was told by my landscaper that the tree should really be removed, its too close. My question is who owns this tree. The fence is not mine and the tree started on my side of the fence and grow up through it and out on my neighbours side of the fence. I know she does not want it cut. What can I do, if I do not own it.? Thank you very much for any direction you can give me.

You can cut any portion of the tree that is on your property.
