Legal Question in Real Estate Law in Massachusetts

Unknowingly signed rights away to property

I purchased a home with my ex-boyfriend in 2000 and resided in it with him until 2003. During a difficult time in January of 2003 which ulimately led to the demise of the relationship, we refinanced the mortgage, keeping only him on the note because we could get a better rate with his credit. At this time, my understanding was that I was to remain on the deed. I have recently discovered that I did in fact sign a new deed stating that I ''hereby sell the property to the other deedholder for a sum of less than $100.00''. Although I realize that I should have examined the document more thouroughly, not being very well versed in this area, I foolishly trusted my ex because he is a mortgage broker. Do I have any legal recourse for the funds that I contributed to the property for three years, or do I just have to chalk this up to a hard lesson learned?

Retain an attorney to discuss whether you can prove you were fraudulently induced to sign the "deed".

You can file an equitable action to establish a constructive trust, and possibly obtain a lien at the outset of the litigation.
