Legal Question in Real Estate Law in Massachusetts

A ZBA special permit was granted to a neighborhood resident to allow an appr. 900 sq. ft. house to be torn down and replaced with a 4600 sq. ft. dwelling in a neighborhood of 900-1200 sq. ft. houses. The project was never finished, the house is rotting and an enormous eyesore. Neighbors feel this has ruined property values in the area and is extremely unsightly. Can anything be done abou this situation?

You can ask the town to file a nuisance claim and seek the demolition of the home or your group can get together and seek the same be done.

I would check to see who owns the property now, which I suspect is a bank or lender. You need to also check if the property is part of a bankruptcy before taking action in court.

Consider retaining an attorney to determine whether the town might be asked to order it demolished as a nuisance. Good Luck!
