Legal Question in Sexual Harassment in Massachusetts
I am a man who was continuously sexually harrassed by a man at work over 3 years ago. This man would walk by quickly touch my crotch, and rear end at times. Even when scheduled on the register next to him he would bump his rear end to mine. Two managers would witness these assaults and laugh when I would say "can someone tell him I'm not gay". Stunned by the laughs it made things even more uncomfortable considering approaching the head manager. Finally it led up to me raising my voice in the employee parking lot to the offender. The next morning a manager told me we're going to talk to the head manager because the offender felt very threatened.
No one was written up, the harrassment was known by the head manager , I felt good and was confident it was done with. I thought I would let it go and carry on.
About a week later the harrasser comes up to me while I'm on the sales floor and quickly massages my shoulders and chest saying"I'm so glad we're getting along again". I tell him to stop and that if he does it again I'll go regional managers and really make this a big deal". Later that day he leaves work on his break and quits. that same day a manager comes to me and says" what did you say to your boyfriend he never came back to break."
Still today empoyees have joked about it and let me know when this offender stops in the store once in a great while . Here and there I would express myself to some lower managment saying" I should go to the regional myself to see that the managers that joked were reprimanded properly". At one time I was responded by" That still bothers you? why would you do something like that? (because it was wrong). Recently an unhappy employee bothered me as I worked chanting the name of the man who harrassed me. words were exchanged and then he called a head manager over stating there was a problem. since then the unhappy employee has gone to human resources accusing me of? and I did as well giving a description of the original events and how it is still joked about today. I feel very cornered, this is a large company, what should I do?
I've worked with this company over ten years and up until the assaults and working in this store I have had outstanding reviews before my transfer.

You definitely need to talk to a lawyer about going to the Massachusetts Commission Against Discrimination. YOu should file a complaint against your compoany and the harrasser!
