Legal Question in Sexual Harassment in Massachusetts

Non profit business - small business harassment

There have been complaints of sexual harassment by a supervisor groping himself has he talks to female employees and volunteers. He has been spoken to but never official addressed. We were told that nothing could be done because we are a very small company (less than a dozen employees) and that the company is non profit and needs him. It is possible that he is not even aware that he does this. Is our information correct that there is nothing that can be done? If we can do something can we remain in the employment? Thank you.

Your company cannot ignore your complaint becuase they "need" the guy. Contact the Massachusetts Commission Against Discriminjation. If his behavior makes it difficult for you to do your job, that is sexual harassment.

It is not true that nothing can be done. Under Chapter 151B, the sexual harassment statute - the employer must have 6 employees. However, there are other statutory remedies available - depending on the nature of the conduct.
