Legal Question in Sexual Harassment in Massachusetts

posting photoshopped picture online

Hello:

I would like to know if it can be considered libel and or sexual

hassassment if a person uses a picture off the internet, photoshops it to

make it extremely crass, and then posts it on the internet w/o the

explicit authorization of the person in the photo. Pls, let me know. Thx.

Re: posting photoshopped picture online

Hi and Thanks for Writing -

My name is Len Foy and I'm an attorney practicing in Massachusetts & New Hampshire.

I'm familiar with cases, similar to your case, where a person using "cut & paste" technology has doctored photographs of another person, mass-produced the photos and then manually distributed the photos - they got into a great deal of trouble doing this. The nomenclature of the tort, I believe, is "false light," or tortiously placing another person in a false light without their consent.

If the facts are substantially as set forth in your question, you may well have a case against this person.

My name is Len Foy, I'm an attorney with Gould & Gould, our telephone number is (603) 434-3437, feel free to call our office if you'd like an initial consultation.

Oh and by the way, I see that you're located in the Commonwealth of Massachusetts - let's hope that the Boston Red Sox come up big in Game 1 of the World Series tonight - GO SOX!

Regards and Good Luck -

Len Foy
