Charged with Sexual Harassment, what now..
If you have not been reinstated, see a lawyer to explain your rights. A lot depends on your relationship to the complaining students, who your employer is, and the history before your suspension, as well as policy of your employer. Your company may have a policy that you are to be granted a hearing. Having a lawyer there is often very helpful.
If you end up being dismissed for cause, you may not be eligible for unemployment benefits, and finding another job may be very difficult. Having an attorney who can speak for you to your employer can be very valuable.
This message is provided to assist you in structuring your thoughts when you speak with an attorney about your situation. I am not your attorney, and you are not my client, so this is not legal advice. Legal advice can only be given after a careful interview of the client by the attorney, and I have not had the opportunity to understand the significant issues that I must understand to render legal advice. You should contact an attorney in your state to discuss your situation. That attorney can give you the advice that your situation deserves, after carefully considering the issues that are legally significant in your situation.
Perception of Undressing Eyes
Were the complainants identfied? that is, notanonymous? oral complaints? or written ones? How many? How long were your eyes on thecomplainants? Minutes? Seconds? Frequency? Same ones? How many different ones?Assuming the complaints were in writing, have you seen them? How many allegedcomplaints were there before complaints were made? Why did company wait until morethan one comlaint was made? Was there a grievance policy? Had you ever fought thecompany by a grievance? Did the company have a reason -- or a desire -- to confront youallegedly only after allegedly multiple complaints were made? Are you white or a person ofcolor? Are the alleged complainants white or persons of color or a mixture thereof? Are youin the same, higher, or lower job position than the complainants? As you can see, there areloads of questions to be both askd and answered. No attorney can give you solid adviceuntil more details are supplied. Did the complainants file at MCAD? That is, have any ofthem sued you or the company? Good luck!
