Legal Question in Social Security Law in Massachusetts
Question on social security benefits. If you are age 53 and disabled and did not remarry and you were married to your ex spouse 17 years and have been divorced for 12 years but ex spouse is 52 and works for the state; can you collect his social security earlier because you are disabled? Yes, his would be higher.

At this time, you are not eligible to collect under your ex-spouse's benefits because you are not age eligible and your ex-spouse has not reached retirement age (age 62) or collecting Social Security disability benefits. You would be eligible to collect when you reach age 62 and if you are not remarried at that time.
