Company gave W2 with zero income

I am on H1B visa and for the year 2003, my employer didnt pay me regularly and even though my taxes were deducted from the pay,the company never paid the taxes to IRS. Now the company is going to provide a W2 with zero income received for the year. Would this get me into trouble?

What would you suggest i shd do?

Any time you sign a tax return, you are signing under the pains and penalties of perjury that the information contained therein is true and accurate. Thus, if you sign a return showing zero income, when you made money, should subject you to liability. The fact that amounts were withheld and not paid is troublesome in many respects. In fact, you may be due a refund of some of the amounts paid. You should discuss this matter with a tax professional, either an attorney or CPA.
