CPA Mistakes

A CPA calculated my 2008 estimated tax payments incorrectly. I now owe $5000 plus penalties. He also figured my 2007 taxes incorrectly (did not use form 2210 and did not even notify me that I owed a penalty). Can I sue to recover tax prep costs, the $5000, or legal fees? Should I go to small claims or hire a lawyer?

First, I would call the CPA and ask him to handle the matter without charge and see if he can get the penalities and interest waived.

And if he cannot do so, ask him to pay the interest and penalties. He would not be liable for the Tax itself. His mistake cost you the penalty and interest.

If he refuses, you can file a claim depending on the amount in small claims. However, make sure that you provided all the information to properly preparing the taxes.
