I don't know what form you are referring to so it is difficult to know how to advise you. However, failure to issue w-2's on time is subject to an IRS penalty.

I would suggest you write a polite letter requesting the W-2 and then if you get nowhere contact the local labor department for assistance.

The same applies to 1099's, but without knowing more about the problem it is difficult to give a more precise response
